Federal Court Agrees that California’s Prop. 8 Is Unconstitutional
On Tuesday the U.S. Court of Appeals for the Ninth Circuit ruled that Prop. 8, the voter approved ban on California gay marriage, is unconstitutional, upholding a lower court’s ruling that the ballot measure. The court also rejected the argument that U.S. District Court Chief Judge Vaughn Walker should have recused himself from the case because he is gay and has a longtime partner.
The Los Angeles Times reported before the ruling that the losing party can appeal the ruling to a larger panel of the 9th Circuit, which would delay a Supreme Court review for many months or longer, or go directly to the high court. Read more.

No shit it’s unconstitutional. Replace the word “gay” with anything else and you’ll see why (black, Jewish, interracial). Opponents of gay marriage are ultimately fighting a losing battle against reason and are on the wrong side of history.
